2. What these terms cover

These terms cover access to and use of the site. They do not govern any finance that may be offered to you. Any facility letter, loan agreement, security document, or other transaction document that we agree with you will apply separately and will take priority if it conflicts with these terms.

3. Information only — no offer or advice

Information on the site is general information only. It is not an offer or commitment to provide finance and does not constitute financial, legal, tax, accounting, or other professional advice. You should obtain advice appropriate to your circumstances before acting on information on the site.

4. Applications for finance

Submitting information or an application through the site does not guarantee that finance will be available or that an offer will be made. Any proposal is subject to eligibility checks, credit assessment, due diligence, internal approval, satisfactory documentation, and the terms of definitive transaction documents.

5. Your account and information

The application service is intended for people aged 18 or over who are authorised to act for a business seeking finance. You must provide information that is accurate, complete, and not misleading, and keep it up to date where the site allows. You are responsible for keeping sign-in links and account access secure. Please tell us promptly using our security contact page if you suspect unauthorised access or misuse.

6. Acceptable use

You must not:

  • use the site unlawfully, fraudulently, or to mislead another person;
  • attempt to gain unauthorised access to the site, another account, or any connected system;
  • introduce malicious code, interfere with security controls, or impair the operation of the site;
  • scrape, copy, or use automated means to access the site except with our prior written permission; or
  • infringe our rights or the rights of another person.

7. Intellectual property

We or our licensors own the intellectual property rights in the site and its content. We grant you a limited, revocable, non-exclusive right to use the site for your own legitimate business purposes. You may not reproduce, adapt, distribute, or commercially exploit the site or its content without our prior written permission, except where the law permits it.

8. Availability and accuracy

We take reasonable care to keep the site secure, available, and accurate, but we do not guarantee uninterrupted access or that all content will always be complete or current. We may suspend, withdraw, or change all or part of the site where reasonably necessary, including for maintenance, security, legal, or regulatory reasons.

9. Third-party services and links

The site may link to or use services provided by third parties. Links are provided for convenience and do not mean that we endorse the linked content. Third-party services and websites are governed by their own terms and privacy information, and we are not responsible for their availability or content.

10. Privacy and cookies

Our privacy notice explains how we use personal data collected through the site. Our cookies notice explains the cookies used to operate it. These notices form part of the information available to you but are not contractual terms.

11. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. Subject to that, we are not liable for losses that were not reasonably foreseeable when you began using the site, or for indirect or consequential loss. If you use the site for business purposes, we are not liable for loss of profit, revenue, business, anticipated savings, goodwill, or business opportunity arising solely from use of, or inability to use, the site. Nothing in these terms affects rights that cannot lawfully be excluded.

12. Suspension and termination

We may restrict or suspend your access if we reasonably believe that you have breached these terms, created a security risk, or used the site unlawfully. We may preserve information and cooperate with regulators or law-enforcement bodies where required by law.

13. Changes to these terms

We may update these terms to reflect changes to the site, our business, or applicable law and regulation. The date at the top shows when they were last updated. We will give reasonable notice of a material change where appropriate. Changes do not alter transaction documents already agreed with you.

14. Governing law and jurisdiction

These terms and any non-contractual obligations arising from them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except where applicable law gives you the right to bring proceedings elsewhere.

15. Contact
